Complete brief description of a Pennsylvania state law regarding juvenile transfer to adult criminal court. Then, explain whether the defendant in the case, in your state, would be transferred and why or why not. Finally, explain whether any forensic assessment might be necessary and why or why not.

Case study:

A 15-year-old male is one of three individuals arrested and charged with the murder of an elderly female who had been robbed and badly beaten in her home during an apparent home invasion. The other co-defendants were both adults, one being the 15-year-old's 18-year-old brother and the other being a 22-year-old non-relative. The victim died from her wounds three days after the home invasion. The prosecutor in the criminal case has filed a motion to have the 15-year-old transferred from the juvenile courts to criminal court. The 15-year-old's attorney is arguing that her client should remain under the jurisdiction of the juvenile courts. She has publicly revealed that the 15-year-old has been diagnosed with Borderline Intellectual Functioning, various learning disabilities, and has taken medication for Attention-Deficit/Hyperactivity Disorder. The 15-year-old has attended special education classes in the past and was recently expelled from his assigned school, but was attending an alternative school prior to his arrest. He is the second of five children born to his mother. Prior to his arrest, he lived with his mother and has no had contact with his biological father in over eight years. His father has previously served time for aggravated assault and domestic violence convictions. The 15-year-old's three younger siblings have two different fathers among them, neither of which were the 15-year-old's biological father. His older brother is said to be his only “father figure.”
