Although the wide spread violation of the intellectual property has been a constant issue in the information technology industry such as file-sharing over the internet, a protection of the intellectual property is an old idea as stated in the Article I, Section 8 of the United States Constitution, known as the Copyright Clause. It states that it empowers the congress “To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries.” Copying the physical digital media was already a problem before the internet era, but the distribution needed to be still carried out physically. Now because of the internet the distribution has been made very easy. The protection of the intellectual property is more important because the internet has allowed digital items to travel over the networked computers with almost no cost.
When it comes to the discussion of the intellectual property of the digital media such as music CD's and DVD's, the argument is often made from the view point of the consumers. Most of us are consumers of those products, we usually report on the case of Napster and talk about the chronological development of the infringement case between Napster and the production side party including musicians and record labels and find about how the businesses evolved to create the new business models to adopt the unchangeable trend of file-sharing culture especially among the young generations. In this report, however, I examine how to create a new multimedia product and distribute them in the market without violation of the intellectual property law. By looking from the producer's point of view, the new way of understanding the ethical issue of the intellectual property may be possible.
